Diagnostic Mérules
Le diagnostic mérule doit être réalisé pour tout type de bien bâti situé dans une zone à risques. Ces zones à risques sont fixées par arrêté préfectoral.
Il a pour but de rechercher la présence de mérule. Les mérules sont des champignons dits lignivores qui s’attaquent aux ouvrages en bois, plâtre, pierre, etc. En cas de vente immobilière, il n’y a aucune obligation de réaliser un diagnostic mérule.
La loi ALUR (Articles L133-7 à L133-9 du CCH) mentionne le fait que lors d’une vente d’un bien situé dans une zone répertoriée par arrêté préfectoral, la présence d’un risque de mérule doit être obligatoirement signalée, rendant ainsi le diagnostic mérule quasiment obligatoire dans toutes les zones à risques. En effet, la nuance entre signalement de présence de mérule et obligation de réalisation du diagnostic mérule est assez fine, les vendeurs et bailleurs ont l’obligation de signaler au futur acquéreur ou locataire la présence de mérule s’ils en ont connaissance ou si leur présence a été détectée et signalée à la mairie.
Afin de se protéger contre d’éventuelles poursuites, il est donc fortement conseillé de faire réaliser le diagnostic mérule par un professionnel certifié.
